Osiptel: dos años de retraso en aprobar medición al segundo en llamadas fijo móvil
Negligencia de OSIPTEL viola Código de Defensa del Consumidor al perjudicar interés económico de los usuarios. Las tarifas fijo móvil serán determinadas por las empresas de telefonía fija igualmente con retraso de dos años, explica congresista Yohny Lescano
Acerca de la publicación de la Resolución del Consejo Directivo de OSITEL N.º 045-2011-CD/OSIPTEL, en el diario El Peruano, que dispone el inicio del procedimiento de oficio para la fijación de tarifas tope de llamadas locales desde teléfonos fijos a teléfonos móviles, el Congresista Yonhy Lescano señaló que este procedimiento tiene un retraso de más de 2 años puesto que debió haberse realizado el año 2009 en que debía concluir el sistema todavía vigente en relación a estas tarifas.
Lescano, miembro titular de la Comisión de Defensa del Consumidor del Congreso, agregó que junto con esta resolución también se publicó hoy en El Peruano la Resolución N.º 044-2011-CD/OSIPTEL en virtud de la cual se ha cambiado el sistema de cálculo de estas tarifas. Por ejemplo, ya no serán las empresas de telefonía móvil las que determinen las tarifas fijo móvil, sino que quienes determinarán estas tarifas a partir de la vigencia de esta resolución serán las empresas de telefonía fija. Pues bien, este sistema debió estar vigente desde el año 2009, puesto que el establecimiento de estas tarifas fijo móvil por parte de las empresas de telefonía celular era para facilitar la expansión de la telefonía celular, objetivo largamente cumplido al año 2009 en que la penetración celular era de alrededor del 70%.
El parlamentario enfatizó que este retraso de 2 años ha perjudicado la economía de los millones de usuarios de telefonía puesto que durante estos 2 años estas tarifas eran libres, debiendo ser tarifas reguladas por el OSIPTEL.
El perjuicio ocasionado es de varios cientos de millones de dólares y en este caso el OSPIPTEL ha violado el Código de Defensa del Consumidor puesto que esta norma señala como derecho del consumidor a que el Estado defienda sus intereses económicos.
De otro lado, el nuevo sistema de tarifas que recoge la citada Resolución N.º 044-2011-CD/OSIPTEL señala que las tarifas serán establecidas, tasadas y cobradas al segundo, quedando prohibido su redondeo. Este es otro aspecto en el que se ha perjudicado a los usuarios puesto que en los 2 últimos años se ha seguido haciendo el redondeo al minuto.
El parlamentario explicó que dado que esta Resolución N.º 044 de OSIPTEL, ha establecido para las llamadas fijo móvil la tarificación al segundo, este es un argumento que abona a favor de que se generalice la medición al segundo en telefonía, de suerte que también se tarifique al segundo las llamadas de fijo a fijo, cuestión que está propuesta en el Proyecto de Ley N.º 0057-2006/CR que está en el Pleno del Congreso desde el año 2006 durmiendo el sueño de los justos.
Este proyecto, de autoría del Congresista Lescano, propone la medición al segundo en telefonía fija, razón por la cual el parlamentario solicitará la priorización a fin de que sea prontamente debatido y sometido a votación en el Pleno del Congreso.
